Blood and Blood Products Policy

Law
establishing a National Policy for Blood and Blood Products
in Brazil.
President Fernando Henrique Cardoso has sanctioned Law 10.205,
of March 21, 2001, setting forth the National Blood Policy
for Brazil. The Law ratifies the prohibition of the marketing
of blood and its products, and regulates paragraph 4°
of Article 199 of the Federal Constitution. |

The Law also allows reimbursement to the sanitary surveillance units
of the costs involved in the processing of the blood and blood products
used by patients of Brazil's Unified Health System (SUS). Blood
components consist of plasma, globulins and plaques. Blood products
consist of immunoglobulins, albumin and coagulation factors.
The Blood Law was submitted to Congressional approval nine years
ago. During the intervening period, regulating blood-related issues
had to be done on the basis of Decrees and Norms.
With the entry into force of Law 10.205 of March 21, 2001, the blood,
blood products and components policy that the Ministry of Health
has been developing since 1998 has been given an important boost.
The overall aim is to guarantee access by all Brazilians to sufficient
quantities of good quality blood.
In addition to the prohibition placed on the marketing of blood,
the Law also covers a number of other key topics, namely:
a) Brazil to continue to make efforts towards guaranteeing self-sufficiency
in the production of blood components, and
b) the qualitative unification of the blood-bank network and the
building of a national blood system. |
