Resolution - RDC 105 of May 31, 2001 (*)

The Collegiate Board of Directors of the National Sanitary Surveillance Agency, in pursuance of the prerogatives conferred upon the Board by Article11, Numeral IV, of the Regulation of ANVISA as approved by Decree 3.029, of April 16, 1999, c/c paragraph 1 of  Article111, Clause I, item "b", of the Bylaws approved by Administrative Rule 593 of August 25,  2000, republished in the Federal Official Gazette - DOU - DOU of December 22, 2000, at their meeting convened on May 30, 2001,

WHEREAS

the provisions set forth  in Law  9.782, of January 26, 1999, which  determine the regulation, monitoring and inspection of products and services that involve a risk to public health,

has adopted the following Resolution, applicable to tobacco leaves and tobacco products which are processed, manufactured, transported, marketed and/or stored throughout  the  territory of Brazil , and whether imported or for purposes of export.

Article 1 - All Brazilian national manufacturing companies and companies which import or export  products derived from tobacco, whether smokable  or not,  must be compulsorily registered, all the products derived therefrom and tobacco processing companies must be registered annually.

Sole  Paragraph -  For the purposes of this Resolution, the following definitions apply:

I - Processing company: any company headquartered in Brazilian territory which purchases, processes and stores tobacco leaves for the purpose of commercialization to national or foreign companies that manufacture tobacco products;

II - National manufacturing company: any company headquartered in Brazilian territory which processes or manufactures any product derived from tobacco, whether smokable or not, for the purpose of commercialization in the Brazilian domestic and/or foreign market;

III - Importing company: any company which imports processed tobacco or any manufactured product derived from tobacco, whether smokable or not, with the purpose of distribution or commercialization in the Brazilian domestic market.

IV - Exporting company: any company which exports processed tobacco or any manufactured product derived from tobacco, whether smokable or not, with the purpose of distribution or commercialization in the foreign market.

 

Registration of the Company

Article 2 -  All  tobacco processing companies, national manufacturing companies, importers or exporters of products derived from tobacco, whether smokable or not, must present an application for registration to the Docket Sector of ANVISA. The application  must be supported by the following documents:

I   - Form 1 – Company Registration Information; and

II - A Statement, registered at a Public Notary Office, indicating the qualifying status of the company making the application, in accordance with its size, and in line with the model shown in the annex of Resolution RDC no 6 of 2 January 2001, which can be obtained on the homepage of ANVISA, http://www.anvisa.gov.br.

Paragraph 1 -  In the case of tobacco processing companies, the registration application must also be accompanied by the data on the processed tobacco  throughout the fiscal year, included in Form 2 - General List of Types of Tobacco and Additives Used, displayed in the Annex.

Paragraph 2 - After the company has been duly registered, any alteration of this information must be  directed to ANVISA within a maximum period of 30 (thirty) days from the date the information is modified.

Paragraph 3 - The form required for registration of the company, displayed in the Annex, is available on-line, from the System for the Registration of Tobacco Products (SISTAB), which can be found on the electronic page of ANVISA, and can also be obtained directly from ANVISA headquarters.

Paragraph 4 - The information completed on the SISTAB system must be handed over in diskette or CD-ROM to the  Docket Sector of ANVISA upon application for registration.

Deadlines for Company  Registration

Article 3 - The application for company registration is to be forwarded only once.

Sole paragraph - The application  for registration of processing company is to be forwarded annually by January 31 of the year following the fiscal year.

Registration of the Product

Article 4 - All national manufacturing companies, as well as those companies which import or export tobacco products, whether smokable or not, must present to the Docket Sector of ANVISA a separate application for registration for each product marketed under a brand name, applicable to each product  according to the features distinguishing it from others such as  tar levels, composition,  flavor, aroma and others.

Paragraph 1 -  The application for registration must be supported by the following documentation:

 I – An original receipt proving payment of the Inspection Fee effected through the  Sanitary Surveillance Fee Collection Voucher (GRVS), drawn up under RDC  28 of December 20, 1999, and available on the electronic page of ANVISA, or by completing the Federal Tax Collection Voucher (DARF). Instructions on how to fill out the latter can also be obtained from the ANVISA electronic page.

II – A photocopy in color of the complete packaging intended for presentation to the end consumer, in accordance with the instructions set forth in Resolution RDC 104, of May 31,  2001;

III – The registration details referring to the production, sale and composition of the product according to the type of product.

Cigarettes

Article 5 - Regarding cigarettes, the registration data included in the following forms and tables, published in Annex, shall be required:  

I - Form 2 – General List of Types of Tobacco and Additives Used;

II - Form 3 - Product Registration Information

III -  Table 1 -  Composition of the Product -  type and amount of tobacco used in the product;

IV - Table 2 - Composition of the Product -  additives contained in the product;

V - Table 3 -  Composition of the Product - specifications of the filter and wrappers;

VI - Table 4 -  Composition of the Product - studies undertaken;

VII - Table 5 -   Compounds present in the mainstream smoke  of the product;

VIII -  Table 6 - Compounds present in the sidestream smoke  of the product;

IX -   Table 7 - Compounds present overall in the  tobacco;

X -  Table 8 - Data  regarding Sale and Production - monthly amount of the product sold per (Brazilian) state ;

XI - Table 9 - Data regarding Sale and Production - monthly amount exported, according to country of destination;

XII - Table 10 - Data regarding Sale and Production -  monthly amount imported , according to country of origin;

XIII - Table 11 -  Data  regarding Sale and Production -  monthly amount produced; and

XIV - Table 12 - Data  regarding Sale and Production - monthly sale price charged to consumers according per (Brazilian) state).

Smokable tobacco products, except cigarettes

Article 6 - For smokable tobacco products, except cigarettes, the registration data included in the following forms and tables, published in Annex, shall be required:

I - Form 2 – General List of Types of Tobacco and Additives Used;

II - Form 3 - Product Registration Information

III -  Table 1 -  Composition of the Product -  type and amount of tobacco used in the product;

IV - Table 2 - Composition of the Product -  additives contained in the product;

V - Table 4 -  Composition of the Product - studies undertaken;

VI - Table 7 - Compounds present overall in the  tobacco - companies may present a summary report containing only pH determination and nicotine, ammonia and euginol levels present in overall tobacco;

VII -  Table 8 - Data  regarding Sale and Production - monthly amount of the product sold per (Brazilian) state ;

VIII - Table 9 - Data regarding Sale and Production - monthly amount exported, according to country of destination;

IX - Table 10 - Data regarding Sale and Production -  monthly amount imported , according to country of origin;

X - Table 11 -  Data  regarding Sale and Production -  monthly amount produced; and

XI - Table 12 - Data  regarding Sale and Production - monthly sale price charged to consumers according per (Brazilian) state).

Non-smokable tobacco products

Article 7 - For non-smokable tobacco products the registration data contained in the following forms and tables, published in Annex, shall be required:

I - Form 2 – General List of Types of Tobacco and Additives Used;

II - Form 3 - Product Registration Information

III -  Table 1 -  Composition of the Product -  type and amount of tobacco used in the product;

IV - Table 2 - Composition of the Product -  additives contained in the product;

V - Table 4 -  Composition of the Product - studies undertaken;

VI - Table 7 - Compounds present overall in the  tobacco - companies may present a summary report containing only pH determination and nicotine, ammonia and euginol levels present in overall tobacco;

VII -  Table 8 - Data  regarding Sale and Production - monthly amount of the product sold per (Brazilian) state ;

VIII - Table 9 - Data regarding Sale and Production - monthly amount exported, according to country of destination;

IX - Table 10 - Data regarding Sale and Production -  monthly amount imported , according to country of origin;

X - Table 11 -  Data  regarding Sale and Production -  monthly amount produced; and

XI - Table 12 - Data  regarding Sale and Production - monthly sale price charged to consumers according per (Brazilian) state).

Article 8 - The forms and the tables published in the Annex are available electronically  from the System for the Registration of Tobacco Products (SISTAB), available on the electronic page of ANVISA. In addition, or alternatively, the relevant forms can be obtained directly from ANVISA headquarters.

Sole Paragraph - The information filled out on the SISTAB system must be delivered in diskette or CD-ROM form to the Docket Sector of ANVISA upon application  for registration. Printed copies of the filled out forms will not be accepted.

Article 9 - Estimated data will not be accepted on levels of compounds present in the mainstream and sidestream smoke of the product and of the overall tobacco, obtained through benchmarking or any other data prognosis technique.

Exemptions from Product Registration 

Article 10 - Smokable tobacco products, including cigarettes, manufactured within the Brazilian territory exclusively for the purpose of exportation, shall be exempted from payment of the inspection fee and from providing the information required in Tables 5, 6, 7, 8, 10 and 12.

Deadlines for Product Registration

Article 11.  In order to comply with the provisions set out in this Resolution, the application for registration of products must be forwarded on an annual basis, in the year following the year of commercialization of the product, by January 31.

Article 12 - In order to comply with the provisions set out in this Resolution, the application for registration of new products to be commercialized must be carried out in two stages:

I - forwarding of initial information, until 3 (three) days before marketing of the product commences, constituting a pre-registration of the product; and

II - the request for conclusion of registration must be accompanied by the original proof of payment of the inspection fee, of photocopy in color of the complete packaging intended for presentation to the end consumer, of Form 2 and of Tables 5 to 12, as provided for in articles 4, 5, 6,and 7. 

General Provisions

Article 13 -  Once the procedures set forth in the aforementioned Articles have been complied with, the registration applications sent to ANVISA will be examined by the Office of Smoking Products of ANVISA, under the technical supervision of the National Cancer Institute Coordination Office for  Prevention and Surveillance (Conprev/INCA/MS).

Article 14 - The registration application  may be rejected when:

I.   the requirements detailed in this  Resolution are not complied with;

II.  the technical requirements referring to the said products are not complied with.

Article 15 - In the event of the registration application being rejected, the requesting company may appeal to the Supervising Director of the Office of Smoking Products of ANVISA within a period of 30 (thirty) days from the date of the rejection of the application. The decision taken at the administrative level will be final.

Article 16 - The marketing in  Brazilian national territory of any tobacco product, smokable  or not, is prohibited unless it is duly registered in the Brazilian Sanitary  Surveillance Agency.

Sole paragraph - Every product marketed in the national territory, including those destined to market research, whose registration application has not been forwarded or has not been accepted shall be immediately removed from the consumer market by the Brazilian manufacturer of the same, or by the importer of the product.

Article 17 - Non-compliance with the provisions set forth under this Resolution constitutes a sanitary violation and the offender will render himself liable to the penalties provided for in Law 6.437 of August 20, 1977 and in Federal Law 9.294 of July 15, 1996.

Article 18 - The Brazilian Sanitary Surveillance Agency, through the Office of Smoking Products, may set forth normative instructions for situations not provided for in this Resolution.

Article 19 - Resolution 320 of July 21, 1999 and  Resolution 2, issued by the Collegiate Board of Directors on October 4, 1999, are both hereby revoked. 

Article 20 - This Resolution enters into force on the date of its re-publication.

Additional information on the carcinogenic potential of some of the components present in or generated by tobacco products

Tobacco-based cigarette smoke contains 4720 toxic substances. Among them is tar, which comprises carcinogenic substances, carbon monoxide, which impedes the taking in and circulation of oxygen by the human organism, and ammonia - which precipitates absorption of nicotine.

When the product is being burnt, a number of different compounds are formed, first in the mainstream smoke then immediately afterwards in the secondary or sidestream smoke. The mainstream smoke derives from the lighted end of the cigarette and passes through the stem of the cigarette until it is drawn in at the mouth.  The sidestream smoke consists of the mixture of compounds emitted to the  environment from the lighted tip of the cigarette.

The following table contains information about the distribution of these compounds in cigarette smoke and the increased risk that they present when inhaled. Table 1 below presents the components of the smoke  associated  to a greater or lesser degree with the development of cancer. The IARC (International Agency for Research on Cancer), is the research reference agency nominated by the World Health Organization to carry out research and analysis into the compounds suspected of causing cancer.

Evidence of carcinogenic risk to humans and animals

Aromatic Amines  - IARC MONOGRAPHS on the evaluation of the carcinogenic risk of chemicals to humans, vol. 38, p. 107-109, 1986

"About 200 amines have been isolated in tobacco smoke. Among these are the following, which have been proven as possessing carcinogenic effects  in human beings: 2-naphthylomine, 4-aminobiphenyl, ortho-toluidyne, aniline, N-phenil-2-naftilamine and ortho-anisidine"

Policyclical aromatic hydrocarbonates - IARC MONOGRAPHS on the evaluation of the carcinogenic risk of chemicals to humans - Tobacco Smoking, vol. 38, pág.100, 1986: 

“Analyses carried out on smoke from cigarettes produced with virginia, burley and oriental type tobacco have verified the presence of at least 35 different policyclical  aromatic hydrocarbonates. The cancerous potential of those compounds to animals and humans has been exhaustively studied.  Benzo[a]anthracenes and benzopyrenes, are notable as having proven carcinogenic effects on human beings.

It was observed that in cigarettes of the bidi type, the presence of these  two compounds was almost twice as high as compared with common non-filter cigarettes (Comparative chemical analysis of Indian bidi and American cigarette smoke, Hoffmann et al., Intl. Cancer Journal , pages 14, 49-53, [1974]. "

" Benzene is found in the mainstream and sidestream  smoke of cigarettes  with and without filters. It is a compound which has already been widely  studied on account of  its capacity  to cause cancer in humans.

Several studies have demonstrated the relationship between exposure to  benzene and a number of types of  leukaemia" .

"Three different types of N-nitrosamines are produced  during the processing of the tobacco and especially when the tobacco is burning: volatile n-nitrosamines, non-volatile nitrosamines and specific nitrosamines of the tobacco. The carcinogenicity of each one of these has been studied by the IARC. Among the volatile n- nitrosamines, the N- nitrosodimethylamine (NDMA) predominates and  possesses proven cancerous potential for humans. Among specific N-nitrosamines of  tobacco, those that possess cancerous potential for human beings  are N'-nitrosonornicotine (NNN) and  4-(methylnitrosamine-1-(3-piridil)1-butanone (NNK)."

“The presence of nitrogen oxides in the mainstream smoke can contribute to the formation of cancerous N-nitrosamines both during the burning phase of the tobacco as in the human organism following inhalation of the smoke, affecting both smokers and passive smokers." “Over 200 semi-volatile phenols in cigarette smoke were identified. We found phenols in the top leaves of the tobacco plant. Eugenol is found in high concentrations in Indonesian  cigarettes  (cigarettes from Bali or kreteks). This compound can cause facial paralysis, among other symptoms."
