Administrative Order nº 772, of October 2, 1998 (*)

The Secretary of Sanitary Surveillance of the Ministry of Health, in the use of the attributions vested in him, and WHEREAS:

the provisions of Decree-Law No. 986, of October 21, 1969; of Law No. 6.360, of September 23, 1976; of Law No. 6.368, of October 21, 1976; of item I of Administrative Order GM/MS No. 107, of March 9, 1978; of Law No. 8.080, of September 1990; of Decree No. 87, of April 15, 1991 and of the Resolutions of the Common Market Group - CMG already adopted in Brazil;

the need to exercise sanitary control of the entire production chain, from manufacturing or importation to consumption, in order to prevent public health hazards, by means of inspection of national or imported products to ensure that they are produced, imported, distributed, preserved, transported and manipulated according to the requirements set forth in the relevant legislation;

the need to speed up and standardize procedures related to clearance of imported goods subject to the sanitary surveillance regimen;

the need to inform interested parties as to the sanitary requirements provisioned for in legislation regarding prior authorization for importation of certain categories of products, as well as the sanitary inspection to be carried out with a view to customs clearance of the above mentioned goods at Border Stations, Customs Offices and Inland Customs Stations (EADI), decides:

Article 1 - To approve the Procedures to be adopted in the importation of products and raw materials subject to sanitary control as provisioned for in Annex 1 of this Administrative Order.

Paragraph 1 - The products and raw materials mentioned in the Caput of this article are hereby subject to prior and expressed statement from the Ministry of Health in favor of their importation.

Paragraph 2 - Alterations, inclusions or exclusions of products and raw materials listed in Annex 1 of this Administrative Order are hereby conditioned to official publication of the Ministry of Health.

Article 2 - To notify the managers of the Foreign Trade Integrated System (SISCOMEX) as to the practices and procedures that must be complied with regarding customs clearance of imported goods subject to the sanitary surveillance regimen, after prior and expressed statement of the Ministry of Health.

Article 3 - For the purposes of this Administrative Order the following terms are defined as:

Sanitary Inspection: set of technical and administrative procedures, under the competence of sanitary authorities, aimed at ensuring the enforcement of sanitary legislation throughout the entire chain of production, distribution and trade, including importation, in order to ensure the health of consumers.

Physical inspection: a sanitary surveillance instrument to be carried out prior to customs clearance of imported cargo, in order to verify the conditions of the product, its preservation and storage. Its purpose is to verify compliance with requirements set forth in specific sanitary legislation.

SISCOMEX: Foreign Trade Integrated System, set forth by Decree No. 660, of 25/02/92.

Importation License (LI): Prior registration required from cargo subject to Non-Automatic Licensing at SISCOMEX. It is requested by electronic means (on line) by the importer or by its legal representative. It may be requested before or after the loading of goods in the foreign country, in compliance with legal requirements; it is granted after consent from the Ministry of Health for importation of a product or raw material under sanitary surveillance by means of demonstration of fulfillment of the legal requirements by the interested party, prior to customs clearance.

Importation License (LI) prior to loading: Consent of the Ministry of Health for importation of a product or raw material under sanitary surveillance prior to loading cargo in the foreign country.

Importation License (LI) after loading: Consent of the Ministry of Health for importation of a product or raw material under sanitary surveillance, subject to authorization by means of sanitary inspection prior to its customs clearance.

Article 4 - Imported goods subject to the sanitary surveillance regimen under the International Cargo Statement/Customs Billing (MIC/DTA) and the Customs Billing (DTA) must have the Importation License requested in compliance with the procedures described in Annex 1 of this Administrative Order, and granted by the sanitary surveillance authority in office of the Ministry of Health, inside national territory (port, international airport, border station or customs office), after sanitary inspection.

Paragraph 1 For the purpose of fulfilling provisions set out in the Only Paragraph of the article 263 of the Decree No. 91.030, of March 05, 1985, the prior clearance for issuing the MIC/DTA and the DTA of imported goods subject to sanitary surveillance, to be submitted to customs clearance at Border Stations or Customs Offices (EADI), where physical inspection of the cargo shall be carried out, shall be granted automatically, by the sanitary authority in office of the Ministry of Health, at the entry port.
Paragraph 2 Products and substances listed below, not subject to customs clearance at EADI or Border Stations, are excepted from provisions of Paragraph 1 of this article:
a) Substances and medicines subject to special control, pursuant to Procedures 1, 1a and 3.
b) Products and substances aimed at clinical research, pursuant to Procedures 1, 1a, 2, 3 and 4;
c) Blood and blood products, pursuant to Procedure 2;
d) Human Organs and tissues pursuant to Procedure 4.

Article 5 - Prior to customs clearance, products or raw materials listed in Annex I of this Administrative Order are subject to physical inspection of cargo by the Sanitary Authority, in compliance with the administrative procedure pursuant to the same Annex, to effective Inspection programs and other legal devices.

Article 6 - International donations of goods to enter the Country, submitted to the sanitary surveillance regimen, including food, clothes and personal use clothing, including those aimed at philanthropic entities, are hereby submitted to request of Importation license, prior to the loading in the foreign country, to be analyzed by the Secretariat of Sanitary Surveillance in Brasília, in compliance with requirements of Annex II of this Administrative Order.

Only paragraph. The granting of the Importation license of goods mentioned in this article must take place at the point of entry (port, international airport and border station) inside national territory, by prior sanitary inspection.

Article 7 - Products or raw materials under sanitary surveillance to be imported are subject to sanitary inspection prior customs clearance.

Article 8 - Procedures pursuant to clearance of products imported for research or scientific investigation not involving human beings, are hereby conditioned to requirements in specific legislation.

Article 9 - Information to be presented by the interested parties to the Sanitary Authority, pursuant to the present Order and its Annex I, may be supplied through any terminal qualified for this end at the Foreign Trade Integrated System - SISCOMEX; document proof in compliance with legal requirements may also be requested .

Article 10 - In compliance with Communicate MICT/DECEX No. 23, of August 24,1998, the Table of the Foreign Trade Integrated System - SISCOMEX - defining the administrative procedure to be applied to products subject to special conditions or procedures in the Non-Automatic Licensing, must be observed.

Article 11 - The delivery, by the importer, of information inconsistent with data presented for registration of the product and importation licensing constitutes sanitary infraction, punishable in compliance with Law No. 6.437, of August 20, 1977 and other applicable legal devices.

Article 12 - Requirements pursuant to this Order do not apply to the goods whose importation has been initiated prior to the date of its enforcement.

Article 13 - This Order goes into effect in the date of its publication.

Article 14 - Administrative Orders SVS/MS No.190, of December 04, 1996; No. 54, of February 14, 1997; No. 166, of April 02, 1997 and No. 53, of January 15, 1998 are hereby revoked.

PROCEDURE 1: Importation of products subject to request of the Importation License, prior to loading, to be analyzed by the Secretariat for Sanitary Surveillance of the Ministry of Health, in Brasilia. These products must be submitted to sanitary inspection, prior to customs clearance, carried out exclusively by the Sanitary Authority of the Ministry of Health located at the International Port or Airport of Rio de Janeiro, which shall conclude the process of granting the Importation License.

NOTE: Products restricted to hospital use, solely in the cases described by Administrative Orders 783, of October 1, 1998, and 785, of October 2, 1998 are exempt from registration.

PROCEDURE 1a: Products of Prohibited Use in Brazil.
NOTE: The products and substances of prohibited use in Brazil are also prohibited for importation, except in exceptional situations of research purposes, authorized by the Sanitary Authority of the Ministry of Health, and submitted to the request of Importation License, prior to loading, to be previously analyzed by the Secretariat of Sanitary Surveillance of the Ministry of Health, in Brasilia. These products must be submitted to sanitary inspection, prior to customs clearance, carried out, exclusively by the Sanitary Authority of the Ministry of Health located at the International Port or Airport of Rio de Janeiro, which shall conclude the process of granting the Importation License.

· Proof of Philanthropic entity or registration at the National Social Assistance Council, when appropriate.
· Donation letter, in the Portuguese language, with identification of donated cargo, specifying the product(s), conditions of use (new or used), state of conservation, quantity, weight, total volume, manufacturing date of the product and expiry date, when appropriate, bearing consulate visa of Brazil in the exporting country;
· Statement signed by the Technician in Charge of the institution, taking responsibility for any damage caused to the health of consumers as a result of using the products in the country, the purpose and destination of goods being included in the statement;
· Disinfection or decontamination Certificate issued in the country of origin with consulate visa of Brazil, when appropriate;
